MOTION

Upon recommendation of Navid Mehram, Chief Operating Officer - Wastewater Operating Services, the Board of Directors (Board) of the Great Lakes Water Authority (GLWA), authorizes the Chief Executive Officer (CEO) to enter into Contract No. 2201744/SCN-0000118, Proposed Change Order No. 3, “Front Entrance Rehabilitation at the Water Resource Recovery Facility” with Commercial Contracting Corporation (CCC), with no increase in cost for a cost not to exceed $8,367,146.00 and an increased duration of 304 days for a total duration of 1,324 days; and authorizes the CEO to take such other action as may be necessary to accomplish the intent of this vote. 

BACKGROUND

The project is intended to transform the appearance of the front entrance area for GLWA’s Water Resource Recovery Facility (WRRF), which was last constructed and updated over 40 years ago (1980).  The WRRF is the largest single site wastewater treatment facility in the United States, and the front entrance area is the main point of entry to the facility for the vast majority of the five hundred individuals that report to the facility daily. 

This project includes improvements to facility security and improvements (canopies) which protect our team from the weather when coming to and leaving the facility grounds, while also improving traffic flow and parking for all individuals. This project also includes structural repairs made to the surge basin (constructed in 1938), directly below the parking lot and canopy.  The surge basin protects the WRRF in the event of pumping loss by acting as a relief for pressure waves.

As of February 2026, the Front Entrance Project is approximately 65% completed.  The major remaining elements of construction are the installation of the canopies, which also includes solar panel installation, as well as final site cleanup around the canopies, storm drain lines, sidewalk/drive paving, and landscaping.  There is also some remaining interior renovation work to be done at the Guardhouse, including new ceilings, heating, ventilation, and air conditioning, lighting, mill work and windows/doors.   

JUSTIFICATION

Based upon the current status of the project, the agreed upon final completion milestone will not be achieved.  There have been several unforeseen conditions, including permit acquisition delays, canopy supplier issues, surge basin improvements, weather related delays, subsurface utility conflicts with the canopy foundations/redesign, and contractor delays which have contributed to the overall delay of the project.  Additional time is required to complete the relocation of utilities, installation of concrete duct banks, canopy foundation underpinning, and revisions to the design of the elevated ventilation stack structure as well as both canopies. 

Wastewater Engineering (WWE) recommends an extension to the contract time, with no additional costs. WWE performed a schedule impact analysis, including the accountability of each delay and whether liquidated damages should be assessed in accordance with the contract’s terms.  The Contractor has submitted delay/general conditions claims for a total amount of $693,467.92. GLWA, Hubbell, Roth and Clark and CCC have met several times over the last six months to review all the delays that occurred to the project, the allowable cost per the Contract, and possible liquidated damages. It was mutually agreed by both parties to resolve all delays/general condition claims for a net amount of $177,672.22, and that agreed amount is being paid from the Provisional Allowance. Therefore, no additional cost is requested via this Proposed Change Order No. 3.  Any remaining allowance will be credited back to GLWA upon final completion of this project.  The additional project time allows for final construction activity to occur, and for proper project closeout.
